Terms and Booking Agreement

These terms and conditions apply to all our services made available online, through any mobile device, by email, or by telephone. By accessing, browsing, and using our website or any of our applications through whatever platform and/or by completing a reservation, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below.

Terms and Booking Agreement: Terms and booking agreement become effective upon receipt of on online booking and payment via this website.

Booking Transaction:This booking agreement and its terms and conditions is being entered into by Tatiana Lumertz (homeowner) and the responsible party booking this reservation (short term renter).For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

Limited Short-Term Rental: It is expressly understood and agreed that this is a short-term vacation rental and is not a lease or other long-term residential tenancy agreement. This agreement is only for the licensed use of the vacation rental for the stated reservation dates. It creates no property rights in you and no rights to renewal or for recurring usage. You shall not sublet the Vacation Rental or any part of it and shall not assign any interest (in whole or in part) to this Agreement or any rights hereunder.

Minimum Age: The minimum age for the responsible party signing this rental agreement is 21 unless otherwise agreed to in writing by this property owner. In addition, this property owner specifically does not allow the renting of the properties by an adult person 21 or older for the purpose of unsupervised use of persons under the age of 21 for parties such as prom weekends, grad night, spring break or other such occasions.

Authorized Use and Guests: You agree that you will be present at the vacation rental for the entire duration of the reservation and that you will be responsible for the actions and behavior of each individual present at the vacation rental during your stay. This includes ensuring each individual in your party or otherwise present at the vacation rental is aware of and in compliance with the terms identified in this Agreement.

Maximum Occupancy:Maximum occupancy is established by the Ventura Condos HOA and we are not authorized to make exceptions to these terms. Therefore, the maximum number of people that may occupy the vacation rental is indicated in the listing description. For clarification, this number applies to all overnight guests, children, and infants. Unless otherwise approved by myself occupancy over the indicated capacity may result in the immediate removal of you and other members of your party from the vacation rental and forfeiture of all amounts paid.

Check-In:  Any time after 3pm on day of arrival 

Checkout: By 10am on day of departure.

Guests are responsible for being out of the unit by 10am.  Failure to depart on time whether intentionally or by accident is a serious problem for incoming guests, housekeeping personnel, and others.  You will be charged $35 for each 1/2 hour that you are tardy in departing.  If you holdover and cause another guest to be displaced you will be charged these fees plus all costs associated with relocating the guest to another suitable accommodation.  This may be extremely expensive.  Please be sure you carefully check your arrival and departure dates.  

Check-in and Parking Permits:Renters agree to inform the owner the full name(s) of driver(s) as it appears on driver license(s) to complete the check-in process. Once owner receives the aforementioned info, owner will issue via email the “ePass(es)”. The “ePass”, is the document that driver shows to the guards at the main gate upon arrival. The guards will issue a parking pass/access card with a bar code that guests can scan to enter and exit the property at the front/main gate. The parking permit should be displayed on the dashboard during the time of your stay in Windsor Hills.

Cancellation Policy:  Renters may cancel the confirmed reservation at any time and the cancellation must be in writing via email.Travelers who cancel at least 60 days before check-in will get back 100% of the amount they’ve paid. If they cancel between 30 and 60 days before check-in, they’ll get back 50%. Otherwise, they won’t get a refund.

Cancellation Policy and Hurricanes:We will only issue a full refund if either the Orlando Airport, or Disney World are closed. Otherwise, our regular cancellation policy applies to all bookings.

Refundable Damage Deposit: On all rentals we require a refundable deposit of $250.00. The refundable deposit usually goes back to accounts within 5 -7 business days from the departure date. The owner/management company retains the right to retain the damage deposit (either in part or full) to cover excess damage of any kind to the property, missing or damaged furnishings, appliances or property, excessive use of electricity (such as leaving the doors open with air conditioning on), excess cleaning costs or any other condition requiring repair or replacement prior to subsequent guests. The security deposit authorization, less any such charges will be released as soon as the management company has completed its inventory and occupancy report. The owners reserve the right to pursue a guest for recompense for any and all damages caused which may exceed the value of the security deposit and will require payment within 14 days of being served notice of this.

Condition of the Property:Wecare very much about our vacation rentals and strive to keep it in excellent shape. If you notice any problems, hazardous conditions, housekeeping issues, or maintenance issues, please notify me immediately.

Loss os Injuries:The owner accepts no responsibility for injuries associated with the rental of our vacation rental unit, or the use of any sporting equipment on site. Guests are advised to take all necessary precautions to protect yourselves against injuries while using our unit. You agree to enjoy our condo at your own risk to self, guests and family.  This includes, but is not limited, to any and all of our possessions which are offered for our use.  It also includes our complex grounds, and facilities at your disposal.

Personal Items:Owner is not responsible for lost, stolen, or damaged property belonging to guest. Please check with your insurance agent about loss provisions while renting this unit.

Maintenance:  Renters may contact owners at any reasonable hour to request assistance with any problems. We ask that you contact us about any problems in the unit. If there is a need for repairs, we will arrange for quick local repairs, which will be charged to us directly.

Personnel Access:Eventually, it is necessary to enter the unit. In the event that personnel need to enter the unit, renters will be notified in advance and personnel will be escorted by our local assistances. Examples of occasional need to enter the units would be our annual fire inspection and the need to perform routine maintenance and repairs. By agreeing to these terms and conditions,  guests are required to allow entry to these individuals.

PETS: Pets ARE NOT ALLOWED at the Ventura at Windsor Hills condominiums.

NON-SMOKING UNITS: All of our units are non-smoking. Smoking is strictly prohibited both inside our units and in the screened-in patios.

Mediation & Arbitration:In the event of a dispute arising out of this rental – the owners and renters agree to use California small claims court in the jurisdiction of San Diego County up to the maximum permitted, and thereafter to binding arbitration with the prevailing party entitled to court costs and reasonable attorney fees.

Force Majeure:As with any other vacation, there are circumstances completely beyond our control, in which the property may not be available for your booking. Such circumstances are referred to as Force Majeure. In the event of Force Majeure the owners will do their best to make alternative arrangements for you where possible. If they cannot or if the alternative arrangements are unacceptable to you, they will issue a pro-rated refund of monies paid. This will be the full extent of the owner’s liability in such circumstances and the owners cannot be responsible for any other costs connected with any such cancellation, however arising.

Guests and their guests agree to the use of this condo and complex at their own risk. Children must never be left unattended in the unit without a responsible adult.  Guests accept full responsibility for the safety of their children, personal belongings and guests at all times while recreating at Windsor Hills Resort and in our condominium.
